Terms of Use

ExterGym Outdoor Gym App Terms of Use

​These Terms of Use (the “Terms”) govern your use of the mobile application ExterGym Outdoor Gym App (the “App”) provided by ExterGym Ltd (3623400-1) (the “Provider”). By using the App you accept these Terms in full.

​1. License and Right to Use

Provider grants you a limited, non‑exclusive, non‑transferable license to use the App in accordance with these Terms. You may not copy, modify, distribute, reverse engineer or use the App other than as permitted by these Terms or with Provider’s prior written consent.​

2. Accounts and Registration

• Registration: You may create a personal account. By registering you agree to provide accurate and up‑to‑date information.

• Account Responsibility: You are responsible for keeping your credentials confidential and for all activity under your account.

• Account Closure: You may close your account via the App or by contacting support. Provider may suspend or terminate accounts for breaches of these Terms or applicable law.

• Security: Report unauthorized access immediately. Provider is not liable for losses due to user negligence except as required by law.​

3. Health and Safety Disclaimer

Content in the App, including exercise guidance and recommendations, is general in nature. Use of the App and any exercise programs is at your own risk. Consult a physician before beginning any exercise program if you have health concerns. Provider is not liable for injuries or health issues arising from use of the App.​

4. Payments and Subscriptions

• Payment Providers: Payments are processed via third‑party payment providers. The App supports Stripe, Paytrail, Google Play payments and App Store payments. Payment processing is subject to the terms of these providers.

• Prices and VAT: All prices displayed in the App include value added tax (VAT 25.5%) unless otherwise stated. Prices are shown in local currency.

• Subscriptions offered in the App may be monthly or annual, depending on the option selected by the user at the time of purchase. The subscription term and billing period are displayed at the time of purchase before payment is confirmed.

• You may cancel your subscription at any time via your account settings in the App or by contacting support. After cancellation you will retain access to the service until the end of the paid billing period, and the subscription will not renew for the next billing cycle.

• Recurring subscriptions will auto‑renew at the end of the selected billing period unless you cancel before the next billing cycle.

• Provider may change the price of subscriptions. You will be notified at least 30 days before any price change takes effect via the App and/or email. The notice will state the new price and its effective date. You may cancel your subscription before the price change takes effect; cancellation will prevent renewal at the new price but will not affect the current paid period.

• Right of Withdrawal and Digital Content: You have the consumer law right to withdraw from a subscription within 14 days from the date of purchase. For digital content, however, the right of withdrawal ends when you have taken the service into use by logging in to the Service. If you begin using the service before the 14‑day period ends and the service is digital content, the right of withdrawal terminates at the time of login.

• Refunds and Credits: Refunds are handled in accordance with applicable law and marketplace policies. Purchases made through the App Store or Google Play may require refund requests to be submitted through the respective marketplace. Provider may grant refunds at its discretion.

• Taxes: You are responsible for applicable taxes unless otherwise stated. Taxes may be added automatically at checkout.

• Disputes and Chargebacks: Disputing a charge with your bank or payment provider does not relieve you of obligations under these Terms. Provider may recover improper chargebacks or refunds.​

Paytrail Plc acts as a collecting payment service provider and is an authorized payment institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For complaints, please contact the website where the payment was made.

By accepting these terms, the user also agrees to the Stripe Terms of Service (Stripe Checkout User Terms of Service, Finland: www.stripe.com/fi/checkout/terms) and the Privacy Policy (Stripe Privacy Policy, Finland: www.stripe.com/fi/privacy).

5. User Generated Content and Moderation

• Submitting Content and License: You may submit content such as photos, comments and reviews. By submitting content you grant Provider a non‑exclusive, worldwide, royalty‑free, transferable license to use, reproduce, modify, publish and display such content in the App and for marketing.

• User Warranties: You warrant that you have the rights to submit the content and that it does not infringe third‑party rights or laws. You are responsible for claims and damages arising from your content.

• Prohibited Content: Prohibited content includes illegal material, hate speech, violent content, privacy violations, or disclosure of sensitive health data. Provider may remove prohibited content without notice.

• Moderation and Reporting: Provider may monitor and moderate user content. Users can report content via the App. Provider is not obligated to pre‑screen all content.

• Limitation of Liability and Indemnity: Provider is not liable for damages caused by user content. You agree to indemnify Provider against claims, costs and damages arising from your content or breach of these Terms.​

6. Intellectual Property

All App content, branding, text, images, video and code are owned by Provider or its licensors. You may not use them without Provider’s permission.​

7. Limitation of Liability and Indemnification

• Disclaimer: The App is provided “as is” without warranties of any kind. Provider is not liable for direct or indirect damages, including personal injury, device damage, or third‑party actions, except as required by mandatory law. This does not waive consumer protection rights.

• Provider does not guarantee that the App will be available uninterrupted or error-free.

• Provider shall not be liable for delays or damages caused by circumstances beyond its reasonable control.

• Indemnity: You agree to indemnify and hold Provider harmless from any claims, liabilities, damages, losses and expenses arising from your use of the App, your content, or your breach of these Terms.​

8. Third Party Services and Links

The App may contain links or integrations with third‑party services. Those services are governed by their own terms and privacy policies. Provider is not responsible for third‑party actions.​

9. Changes and Termination

Provider may modify these Terms by notifying users via the App or email. Material changes will be communicated reasonably in advance. Continued use constitutes acceptance. Provider may suspend or

terminate the App or user accounts.​

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Finland. Disputes shall be resolved in the Kouvola District Court unless otherwise required by mandatory consumer protection law.

11. App Store and Google Play
Apple and Google are not responsible for the App or its content. All claims and liabilities related to the App are solely the responsibility of the Provider.
